Terms and conditions

1. GENERAL CONDITIONS
1-1- These general conditions regulate the online sale of the products offered to the public by IBERICAPENS, and offered for sale through the technical means that the seller incorporates into them.


2. ADHERENCE TO THE GENERAL CONDITIONS.
The completion and sending of the Purchase Order, by the buyer, expresses full and unreserved adherence to each and every one of the General Conditions, as indicated in the Purchase Order.


3. ORDERS.
Purchase Orders will only be sent to IBERICAPENS, by electronic means from the On-line store. Once a Purchase Order has been received, IBERICAPENS will send a confirmation of the purchase agreement. In the event that at the time of receipt of a purchase order there were no available stocks of the product or products, IBERICAPENS will offer the possibility of waiting for a new delivery period or cancellation of the order.
Orders placed after 12 noon will be shipped the next day.


4. METHOD OF PAYMENT.
4-1 The price of the products will be paid exclusively and only at the customer's choice, by any of the following means:

a) By credit card. This service is directly provided by IBERICAPENS and includes all responsibility in relation to the confidentiality and security of data provided by the client.

b) By bank transfer to CAJA RURAL DE ZAMORA. In this case, the client must indicate the total amount of his purchase, to the beneficiary (IBERICA PENS S.L.), and the order number that will be indicated.

c) By PayPal. In this case through the account created by the user himself.

The costs of conditioning, packaging and shipping of the products purchased, as well as other applicable taxes, are paid by the customer who will proceed to pay them with the price of the product.
For shipments to Ceuta, Melilla and the Canary Islands and to other countries not members of the European Union, the client will be responsible for the amount of customs and / or local taxes and or of each country.

5. RESERVATION OF TITLE.
IBERICAPENS S.L. expressly reserves the domain of the product until full payment of its price, applicable expenses and taxes, as well as default interest.


6. DELIVERY OF THE PRODUCT.
6-1 Transfer of risks. Delivery will be made by making the product available to IBERICAPENS, or by a third party on behalf of IBERICAPENS, at the address indicated by the customer in the order. The merchandise always travels at the expense and risk of IBERICAPENS.

The merchandise always travels accompanied by a delivery note in which the receiver must state any defect found, which could be attributed to the transport, providing a period of 24 hours for any claim. Unless there is a written agreement in the contract, the delay of deliveries will not be sufficient cause for the cancellation of the order or to exercise any claim. The losses, delays or breakages in the transport will be claimed by the part that the transport company consigns (without this making us responsible).


7- RESPONSIBILITY FOR DELIVERY.
IBERICAPENS S.L. will be released from the fulfillment of the delivery obligations and declines all responsibility regarding the following assumptions.

a) Total or partial non-payment of the order made by the buyer.
b) Omission or inaccuracy of the data provided by the customer in the Purchase Order.


8- GUARANTEE.
Current regulations will be applied according to law. An item will always be exchanged for another of the same model and if it were a discontinued item, it will be made for a similar item.


9- RETURNS.
IBERICAPENS is responsible for the quality of its products and admits the return of any defective product, as well as any purchase made erroneously or unsatisfied. The period for claiming or returning a total or partial order will expire 14 days after receiving the order.

As long as the return is caused by non-compliance by the company (defective order or in poor condition), IBERICAPENS will be responsible for the return costs.

If, on the contrary, the item was acquired by mistake of the buyer, the customer will be responsible for the return costs.
